Terms of Service

Bluck provides software for sending and receiving messages through the WhatsApp Business Platform, including a shared inbox, broadcast campaigns, message templates, chatbot flows and related APIs. We are an independent provider and are not endorsed by or affiliated with Meta Platforms, Inc.

You must provide accurate information, keep your credentials confidential, and are responsible for all activity under your account. Tell us promptly if you suspect unauthorised access. You must be at least 18 and using Bluck for business purposes.

Messaging through WhatsApp is subject to Meta's terms, including the WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy and the WhatsApp Commerce Policy. You are responsible for complying with them. Meta may independently review, restrict, suspend or ban your number or WhatsApp Business Account, and we cannot override those decisions.

You agree not to use Bluck to:

• Message people who have not opted in, or continue messaging after someone opts out.
• Send spam, scams, phishing, malware or deceptive content.
• Send content that is unlawful, harassing, hateful, or infringes someone else's rights.
• Promote goods or services prohibited by Meta's commerce policy.
• Impersonate another person or business.
• Attempt to breach, overload, reverse-engineer or circumvent limits on the platform.
• Resell or white-label the service without our written agreement.

You are solely responsible for the content you send and for having a lawful basis to contact your recipients.

Meta charges for messages on a per-message basis, priced by category and recipient country. You pre-fund a wallet in Bluck and we deduct the applicable cost as messages are sent, recording each deduction in your transaction history. If a message fails to deliver, the corresponding amount is credited back.

Rates are set by Meta and can change without notice from us. Wallet top-ups are non-refundable except where required by law, and unused balance is not redeemable for cash. If your balance is insufficient, campaigns pause until you top up.

We aim for high availability but do not guarantee uninterrupted service. Delivery of messages depends on Meta's infrastructure, your messaging tier, your quality rating, and factors outside our control. We may perform maintenance, and may modify or discontinue features with reasonable notice.

You retain ownership of your contacts and message content. You grant us the limited licence needed to host, process and transmit that data in order to provide the service. Our handling of personal data is described in our Privacy Policy.

Bluck, its software, design and branding remain our property. These terms grant you a limited, non-exclusive, non-transferable right to use the service while your account is in good standing.

You may close your account at any time. We may suspend or terminate access if you breach these terms, violate Meta's policies, fail to pay, or use the service in a way that risks harm to others or to the platform. Where practical we will give notice first. On termination your right to use the service ends and we will delete your data in line with our Privacy Policy.

The service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not warrant that messages will be delivered, that templates will be approved, or that your number will not be restricted by Meta.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total aggregate liability arising out of or relating to the service is limited to the amounts you paid us in the three months preceding the event giving rise to the claim.

You agree to indemnify us against claims, losses and expenses arising from your content, your use of the service, or your breach of these terms or of Meta's policies.

We may update these terms as the service develops. Material changes will be notified in the app or by email. Continuing to use Bluck after changes take effect means you accept the revised terms.

These terms are governed by the laws of India, and the courts of India will have exclusive jurisdiction over any dispute, unless mandatory local law in your country provides otherwise.
